E-briefing: Amendments to the SOP Act – Implications for Potential Claimants & Respondents in the Building & Construction Industry

Introduction

  1. In 2018, Parliament amended the Building and Construction Industry Security of Payment Act (the “SOP Act”). The link to the amendment can be found here.
  2. Although not in effect yet, all parties in the building and construction industry should be aware of the pending amendments, as they materially impact a party’s ability to make claims or respond to them. These amendments include:

    • A shortened limitation period to file claims;
    • Reduction in items that can be considered for adjudication; and
    • Requirement for respondents to provide all objections in a valid payment response.
  3. Additionally, the amendments to the SOP Act incorporate the decisions of major cases regarding the existing SOP Act.
